Returned to Derry Crown Court charged with causing death by careless driving

A man charged with causing death by careless driving in a road traffic collision near Claudy has been returned to Derry Crown Court for trial.

Richard Frazer, 44, whose address was given as Stanley Road in Portsmouth, England, has been charged with causing death and grievous bodily injury by careless driving on August 2, 2016.

On that date, Wilson Sherrard, from the Fountain in Derry, died when the car he was a passenger in was involved in a collision with a van on Foreglen Road near Claudy.  He was seriously injured in the accident and died later at Altnagelvin hospital.

Two other men - the driver of the car in which Mr Sherrard was travelling and the defendant - were also taken to hospital for treatment.

It is understood Mr Sherrard was returning from Belfast to Derry when the accident occurred.

On Monday April 16 at Derry Magistrate’s Court, there was no objection to the holding of a preliminary enquiry and the Public Prosecutor said there was a case to answer.

A prima facie case was accepted by a defence solicitor.

The defendant was asked whether he wanted to respond to the allegations, give evidence or call witnesses. On each occasion, Frazer answered ‘not at this stage’.

Holding charges were marked withdrawn and the defendant was granted his own bail of £500.

The 44-year-old will be returned to Derry Crown Court for his arraignment on May 15.
