A 35-year-old Derry man accused of breaking his mother’s arm in a ‘very deliberate’ act after slamming a window shut on it has been granted bail.
Sean Jackson, of Bawnmore Place in Strathfoyle, appeared at the city’s Magistrates’ Court on Monday charged with committing GBH on November 24.
On that date the injured party was on her way to Altnagelvin’s A&E department when she reported that her son, the defendant, had assaulted her at home.
The police went to the hospital and recorded a statement of complaint.
A police officer said the defendant’s mother was watching TV around 11.30pm when he knocked on the front door before going to the front window and asking for food saying, ‘open the f***ing window’.
Due to a history of ‘other matters’ the lady refused at first, but reluctantly got food and handed it to him.
The court herd Jackson ‘grabbed the bag and threw it on the ground’, then ‘opened the window wide and aggressively slammed it down using all of his force on to her left hand’ and proceeded to shout ‘give me f***ing food’, the police officer added.
The PSNI officer said it was ‘very deliberate’ and the 35-year-old ‘showed no remorse’ afterwards.
While in hospital, the injured party was assessed as having a ‘fractured lower radius’
Mr Quigley told the court his client ‘accepts he slammed the window shut’ and explained that Jackson’s address is 0.1 miles away from his mother’s.
The defence solicitor suggested that if an alcohol condition was put in place as part of his bail terms it would go some way to assuaging police concerns.
Granting the defendant his own bail of £750, District Judge Barney McElholm ordered him to have no contact with his mother, and not to go within 200 metres of her address.
The 35-year-old was warned that if he breaches those conditions he will be remanded in custody.
The case was adjourned to a court sitting on December 20.
